2. Purpose and acceptance
This legal notice governs the use of the website https://balearicexperience.com and of the concierge services offered by Balearic Experience. Use of the site implies the user's express acceptance of these terms.
3. Services offered
Balearic Experience acts as an intermediary and coordinator of luxury tourism services in Mallorca and the Balearic archipelago, including, among others: yacht charter, villa rental, organisation of private experiences, private transport, helicopters and jets, dining, and itinerary curation.
Each service booked is governed by the specific conditions communicated to the client beforehand and by the conditions of the end providers (yacht owners, owners, operators), which will be made known to the client before confirmation.
4. Bookings and payments
Service proposals delivered via form, email or WhatsApp are indicative quotes. A booking is considered firm only after:
- The client's express written acceptance of the detailed proposal.
- Payment of the agreed deposit (usually between 30% and 50% of the total amount).
- Our confirmation of the suppliers' availability.
The remaining balance is payable within the periods indicated in each proposal, usually before the service begins.
5. Cancellations
Cancellation terms are set out in each proposal and depend on the policies of the end providers (yachts, villas, operators). As a typical guide in the boutique concierge sector:
- Cancellation more than 60 days in advance: partial refund of the deposit (less handling fees).
- Cancellation between 30 and 60 days: loss of the deposit.
- Cancellation fewer than 30 days in advance: 100% payable with no refund, save in cases of force majeure.
Each specific proposal sets out the applicable terms. We recommend taking out travel insurance that covers cancellations.
6. Liability
Balearic Experience acts as a coordinator. The actual provision of each service (sailing, accommodation, air or ground transport, catering) is the responsibility of the end provider, which holds the applicable licences, insurance and authorisations.
Balearic Experience is not liable for circumstances arising from force majeure, adverse weather conditions that prevent water or air activities, public authority decisions (port closures, anchoring restrictions, etc.), or conduct by the client or their companions that breaches the provider's rules.
7. Intellectual and industrial property
All website content (text, images, brand, design, code) is the property of Balearic Experience or its respective owners and is protected by intellectual and industrial property law. Its reproduction, distribution, transformation or commercial use without express authorisation is prohibited.
8. Data protection
The processing of personal data is governed by our Privacy Policy, which the user acknowledges and accepts by using the site or booking services.
9. Amendment of the terms
Balearic Experience reserves the right to amend these terms at any time. Amendments take effect from their publication on the website.
10. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to Courts of Palma de Mallorca, save for any mandatory rule favouring the consumer.
